1. Parties and subject
This agreement is between RAFMARIN ("Rafmarin" / "Operator") and the boat owner requesting the service ("Customer"), for the storage of the Customer's boat in Rafmarin's indoor rack system and related services.
2. Scope of service
Included in the package fee:
- A dedicated rack section and cradle for the boat's class; placement by forklift
- Haul-out and launch within the package allowance (partner ramp)
- Wash on arrival and before delivery
- Free survey and measurement
- First pick-up within Istanbul free of charge
Winterization, hull cleaning/antifouling, polishing, season-opening service, canvas repair and insurance advisory are add-on services, priced separately and provided on written approval.
3. Fees and payment
- The annual package fee is calculated by the class determined from the boat's overall length (including swim platform and bowsprit) and is paid in advance. Prices are subject to 20% VAT.
- A 15% height surcharge applies to boats with a fixed T-top, radar arch or wakeboard tower.
- Monthly storage (min. 3 months) is 1/9 of the annual fee per month.
- Payment is due within [7] days of the invoice date; the boat is not collected until payment is complete.
4. Movement allowance and notice
- Annual packages include 2 haul-out / launch movements; each movement beyond the allowance costs 7,500 TL + VAT.
- The Customer gives at least 24 hours' notice in the normal period and at least 48 hours' in peak season (June–September weekends), by WhatsApp or e-mail.
- Unused movements do not carry over to the next period.
5. Boat acceptance conditions
- Boats over 12 m, heavier than 5 tonnes, sailing boats with masts and catamarans are not accepted.
- Fuel tank level must be below 25% when the boat enters storage; otherwise a fuel removal service is charged with the Customer's approval.
- The Customer declares the boat's dimensions and equipment accurately; in case of misdeclaration the class and fee are corrected.
- Hazardous materials, gas cylinders, ammunition etc. may not be left on board.
6. Insurance, reports and liability
- A photo-documented report is prepared at every check-in and check-out and shared with the Customer.
- The facility is covered by operator liability insurance; damage caused by the facility is covered under this policy.
- The Customer is responsible for confirming that their own hull insurance covers the dry storage period. Force majeure (earthquake, flood, war etc.) is outside the Operator's liability.
- There is no customer access to the rack system; access to the boat is by appointment only, at ground level, in the workshop area.
7. Term, termination and transfer
- The agreement runs for the selected package term from the start date.
- If the Customer ends the agreement mid-season, remaining months are not refunded; the agreement may be transferred to another boat owner with the Operator's approval.
- If the Customer breaches payment or acceptance conditions, the Operator may terminate after a [15]-day cure period; the boat may be retained until fees are paid (lien).
- A daily [fee] applies to boats not collected at the end of the term.
8. General provisions
Disputes arising from this agreement are subject to the jurisdiction of the Istanbul ([Anadolu / Çağlayan]) Courts and Enforcement Offices. Personal data is processed in accordance with the Privacy Notice. Notices between the parties are given in writing (e-mail / WhatsApp). In case of conflict, the Turkish version prevails.
